Non-Commercial Fishing Regulations

Who Needs a License of Permit

  • Nonresidents must have a Nonresident Recreational Marine Fishing License (NRMFL) to fish in state marine waters.
  • A Freshwater Game Fishing License is required for certain freshwater species.

Core Netting Rules

  • Throw Nets: Minimum 2″ stretched mesh; smaller mesh in/near the water is unlawful. (HAR ch. 13-75-10)
  • Lay Nets: Permit required (annual, non-transferable); nets limited to ≤125 ft long, ≥2¾″ mesh, single net only, tagged and buoy-marked. Strict rules on spacing, depth, time-in-water (≤4 hrs), constant attendance, inspections, and area/time closures; violations can lead to fines, seizure, or permit suspension. (HAR ch. 13-75-12.4 and 12.5)
  • Net Exemptions: Small-mesh hand/scoop nets (≤3 ft) allowed for noncommercial use. Smaller mesh also permitted for pua (pond stocking), baitfish by licensed fishers, and species like ‘ōpae, ‘ōpelu, and makiawa. Surround nets with SCUBA (≥1½″ mesh) allowed for transport only; additional species- and area-specific rules apply. (HAR ch. 13-75)
